Terms of Service

This document constitutes a public offer (oferta) in accordance with Article 395 of the Civil Code of the Republic of Kazakhstan.

Placing an order on baybanugaidar.com constitutes full and unconditional acceptance (acceptance) of the terms of this offer.

The Seller agrees to transfer ownership of goods (clothing and accessories of the BAY by Banu Gaidar brand) to the Buyer, who agrees to accept and pay for them.

Product range, specifications, prices and availability are determined by the current catalogue on baybanugaidar.com. The Seller may change the range and prices without prior notice.

1. Select a product and add it to your cart, choosing the size and colour.
2. Proceed to checkout and fill in your contact details and delivery address.
3. Choose a delivery method and confirm your order.
4. Complete payment via Freedom Pay.

After payment, you will receive order confirmation via WhatsApp or email.

The Seller may cancel an order if the item is out of stock, with immediate notification and a full refund.

All prices are in Kazakhstani tenge (₸) and are valid at the time of ordering.

Payment is made online via Freedom Pay. Accepted cards: Visa, Mastercard, Mir, UnionPay.

The Seller does not store your payment card details — processing is handled exclusively by Freedom Pay (PCI DSS certified).

An order is considered paid from the moment funds are received by the Seller. Orders are not processed until payment is confirmed.

Risk of loss or damage passes to the Buyer when the goods are handed to the delivery service.

Return and exchange conditions are set out on the Refund Policy page.

The Seller guarantees that all items match the descriptions on the website.

The Seller shall:

• Ensure the availability and quality of products as listed in the catalogue.
• Deliver goods within agreed timeframes and in appropriate packaging.
• Notify the Buyer of any changes to delivery times or stock availability.
• Comply with Kazakhstani consumer protection legislation.

The Buyer shall:

• Provide accurate contact information and a correct delivery address.
• Accept and pay for the ordered goods in a timely manner.
• Follow care instructions as indicated on the garment labels.

The Buyer is entitled to return or exchange goods in accordance with the Refund Policy.

The Parties shall be liable for breach of these terms in accordance with the laws of the Republic of Kazakhstan.

The Seller is not liable for delays caused by third-party delivery services or force majeure events.

The Seller's aggregate liability to the Buyer shall not exceed the amount paid for the relevant order.

Personal data is processed in accordance with the Privacy Policy at baybanugaidar.com.

All disputes shall first be resolved through negotiation. The Buyer may submit a written complaint via WhatsApp: +7 778 914 9692. Response time: 10 business days.

If an amicable resolution cannot be reached, disputes shall be referred to the courts at the Seller's place of registration (Atyrau, Republic of Kazakhstan) under Kazakhstani law.

This offer comes into force upon publication on baybanugaidar.com and is valid indefinitely.

Matters not covered by these terms are governed by the applicable legislation of the Republic of Kazakhstan.
